5 Medical Rights Every Patient Should Know


Patients in India are protected by several legal rights within the Healthcare system. However, many people are unaware of these protections. Knowing these rights can help patients ensure proper treatment and accountability from medical professionals. 

Right to Emergency Medical Treatment

Every person has the right to receive immediate medical treatment in an emergency. In the case of Parmanand Katara v. Union of India court held that preserving human life is of paramount importance, and doctors or hospitals cannot refuse emergency treatment. 

Right to Informed Consent

Doctors must explain the nature, risks and alternatives of a medical procedure before performing it. A patient's consent is necessary for any treatment or surgery. This was emphasized in Samira Kohli v. Dr. Prabha Manchanda.

Right to Access Medical Records

Patients have the right to obtain copies of their medical reports and records. Hospital must provide these records within 72 hours according to guidelines of the Medical Council of India.

Right to Privacy and Confidentiality 

Medical information of a Patient must remain confidential and cannot be disclosed without consent. This is also linked to the right to privacy recognized in Justice K.S. Puttaswamy v. Union of India. 

Right to Seek Compensation for Medical Negligence

If a patient suffers harm due to negligence by a doctor or hospital, they can claim compensation under the Consumer Protection Act, 2019.
